Introduction

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and ALN Logistics ("we," "us," or "our").

We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.

User Responsibilities

By using ALN Logistics, you represent and warrant that:

Account Security:

• All registration information you submit will be true, accurate, current, and complete
• You will maintain the accuracy of such information and promptly update such registration information as necessary
• You will keep your password confidential and will be responsible for all use of your password and account

Lawful Use:

• You will not access the Site through automated or non-human means
• You will not use the Site for any illegal or unauthorized purpose
• Your use of the Site will not violate any applicable law or regulation

Communication:

By creating an account, you agree that we may send you occasional promotional or informational texts, emails, or push notifications. You can opt out at any time.

Deliveries & Restricted Items

By requesting a delivery, you guarantee that the items requested are not classified as hazardous material, dangerous goods, or prohibited under any applicable laws or regulations.

Prohibited Items include:

• Firearms, weapons, ammunition, and their components
• Illegal drugs, narcotics, or drug paraphernalia
• Stolen goods or counterfeit products
• Live animals or human remains
• Any item requiring a special license or permit for transport
• Explosives, flammable materials, or radioactive materials

Packaging and Labeling:

You are responsible for ensuring that all items are properly and securely packed to withstand ordinary handling during transit. ALN Logistics is not liable for damage resulting from inadequate packaging.

Pickup and Delivery Points:

You must provide accurate pickup and delivery addresses, and ensure that someone is available to hand over and receive the package at the specified times. Let the recipient know to expect a delivery from ALN Logistics.

Delivery Delays:

While we strive to meet estimated delivery times, these are estimates only. ALN Logistics is not liable for delays caused by severe weather, traffic conditions, road closures, or other circumstances beyond our reasonable control.

Payment Terms

Pricing:

Delivery fees are calculated based on distance, package size, vehicle type, and current demand (surge pricing). The estimated fee will be displayed before you confirm your request.

Payment Methods:

We accept various forms of payment, including credit/debit cards and supported digital wallets. By providing a payment method, you authorize ALN Logistics to charge the applicable fees to your designated method.

Cancellations and Refunds:

You may cancel a delivery request without charge if a rider has not yet been assigned or within a short grace period after assignment. Cancellations after a rider is en route to the pickup location may incur a cancellation fee. Refunds are evaluated on a case-by-case basis.

Tips and Gratuity:

Tipping is entirely optional but encouraged. 100% of any tip provided goes directly to the rider.

Liability and Disclaimers

Disclaimer of Warranties:

The Services are provided on an "as-is" and "as-available" basis. ALN Logistics makes no warranties, express or implied, regarding the reliability, timeliness, quality, suitability, or availability of the Services or any goods requested through the Services.

Limitation of Liability:

In no event shall ALN Logistics, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Services.

Maximum Liability:

Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the specific delivery transaction giving rise to the claim.

Termination of Service

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

If you wish to terminate your account, you may simply discontinue using the Services or submit an account deletion request through the app. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Miscellaneous

Governing Law:

These Terms shall be governed by and defined following the laws of ALN Logistics' jurisdiction of registration. ALN Logistics and yourself irrevocably consent that the courts of that jurisdiction shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

Dispute Resolution:

Any legal action of whatever nature brought by either you or us shall be commenced or prosecuted in the state and federal courts located in ALN Logistics' jurisdiction, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such state and federal courts.

Severability:

If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
